Terms of service
These terms govern your use of CounterRent at counterrent.com. By creating an account or making a purchase, you agree to them. If you do not agree, please do not use the service.
1. What CounterRent is
CounterRent is an online tool that helps renters respond to a lease renewal rent increase. It compares your renewal offer with rental market data for comparable homes near you, tells you whether there is enough reliable data to support a counteroffer, and, if you purchase the negotiation, provides comparable rentals, a recommended counteroffer, a target settlement range, negotiation messages, and analysis of your landlord's replies.
2. What CounterRent is not
- Not legal advice. CounterRent is not a law firm and does not provide legal advice. Using the service does not create an attorney-client relationship. We do not tell you whether a rent increase is lawful or what your rights are under any rent control, rent stabilization or tenant protection law.
- Not a representative. CounterRent does not contact, negotiate with, or act for you with your landlord or property manager. You decide what to send and you send it yourself.
- Not a guarantee. Whether your rent changes is up to your landlord. We do not guarantee any reduction, savings, response or outcome.
- Not an appraisal. Market figures are estimates based on third-party listing and rent-estimate data, which can be incomplete, delayed or inaccurate for a particular area or unit.
3. Your account
You must be at least 18 years old and able to form a binding contract to use CounterRent. You can check your renewal and buy without an account; until you save it, your negotiation is tied to the browser you used, and clearing its cookies can lose access to it. Keep your sign-in details secure; you are responsible for activity on your account. Tell us promptly if you think your account has been accessed without permission.
4. Information you provide
The analysis is only as good as the information you give it. You are responsible for the accuracy of the rent figures, address, unit details, documents and landlord messages you enter, and for having the right to share them with us. Review every message CounterRent drafts before you send it, and edit it if anything is wrong or does not reflect your situation.
5. Free features and the paid negotiation
Checking the cost of your increase and the free market check are available at no charge. The negotiation for a renewal costs $49 in U.S. dollars, paid once. It is only offered when our analysis finds enough comparable market data for that renewal.
- One purchase covers one renewal of one unit, from the first counteroffer through the final outcome, with no limit on negotiation rounds for that renewal.
- It is not a subscription and does not renew or recur.
- A later renewal, or a different unit, is a separate purchase.
- Payments are processed by Stripe. Access is unlocked when Stripe confirms the payment to us, not when you return from the checkout page.
6. Refunds
Refunds are handled under our refund policy, which forms part of these terms. When a purchase is refunded, the negotiation tools for that renewal close, and you keep read access to the analysis you already received.
7. Acceptable use
You agree not to:
- use CounterRent for any unlawful purpose or to harass anyone;
- enter information about a property or person you have no right to share;
- scrape, copy or resell the service or its data, or access it with bots or other automated means;
- try to get around payment, usage limits or security measures, or to access another user's information;
- interfere with the operation of the service.
We may suspend or close accounts that break these rules.
8. Our content and yours
The service, its software, design and written content belong to CounterRent and its licensors. You may use the analysis and messages we produce for your own renewal, including sending the messages to your landlord. You keep ownership of the information and documents you provide, and you allow us to use them to provide and improve the service as described in our privacy policy.
9. Third-party services
CounterRent relies on third parties for hosting, payments, market data and AI processing. We are not responsible for their services, and their availability or accuracy may affect ours.
10. Disclaimers
The service is provided “as is” and “as available”. To the fullest extent the law allows, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement. Decisions about your lease are yours.
11. Limitation of liability
To the fullest extent the law allows, CounterRent will not be liable for any indirect, incidental, special, consequential or punitive damages, or for lost savings, lost profits or the outcome of any negotiation or lease decision. Our total liability for any claim relating to the service is limited to the amount you paid us in the twelve months before the claim arose. Some jurisdictions do not allow certain limitations, so some of these may not apply to you.
12. Ending your use
You may stop using CounterRent and ask us to delete your account at any time. We may suspend or end access if you breach these terms or if we stop offering the service.
13. Changes to these terms
We may update these terms. The effective date above shows when they last changed. Changes apply from that date; a purchase already made stays governed by the terms in place when you made it.
